- A Federal High Court in Lagos
yesterday struck out the suit filed by a telecoms company, Etisalat, challenging
the acquisition of Visafone by MTN.

- Justice Ibrahim Buba struck out the
case on the grounds that the court lacked the jurisdiction to entertain the
suit.

- Adding that Etisalat cannot challenge
the acquisition of Visafone by MTN because the Nigerian Communication
Commission (NCC), which is the regulatory agency saddled with the
responsibility of monitoring and approving such sale is not joined as a party
in this suit.
- - Etisalat Nigeria had sued MTN Nigeria
and Visafone, challenging MTN’s use of the 800megahertz (MHZ) spectrum
following the acquisition of Visafone.
